1. Agreement to These Terms

These Terms of Service ("Terms") are a legal agreement between you and Little Birds ("Little Birds," "we," "us," or "our") governing your use of our website and monthly snail mail subscription service. By using our website or purchasing a subscription, you agree to these Terms and our Privacy Policy.

2. Eligibility and Account Information

You must be at least the age of majority in your jurisdiction to purchase a subscription. You agree to provide accurate, complete, and current billing and shipping information, and to keep that information updated so we can process and deliver your mailings.

3. Subscriptions, Billing, and Renewals

Subscriptions are billed in advance on a recurring monthly basis through Stripe or our designated payment processor. By subscribing, you authorize recurring charges until cancellation. Pricing, shipping region, and applicable taxes are shown at checkout. If payment fails, we may retry payment, pause service, or cancel your subscription.

4. Cancellation

You may cancel anytime using our Stripe customer portal or by contacting us. Unless otherwise required by law, cancellation applies to future billing periods and does not retroactively refund charges already processed for the current period.

5. Shipping and Delivery

We currently ship to the United States, Canada, United Kingdom, Australia, New Zealand, Ireland, France, Germany, Netherlands, Spain, Italy, Sweden, Norway, Denmark, Finland, Switzerland, Austria, Belgium, Portugal, Japan, and Singapore. Delivery times are estimates and may vary by destination and postal conditions. We are not responsible for delays, customs processing, or carrier disruptions outside our reasonable control.

You are responsible for providing a complete and accurate shipping address. We are not responsible for nondelivery caused by address errors provided at checkout.

6. Refunds and Replacement Policy

We want families to have a great experience and handle refund or replacement requests in good faith on a case-by-case basis. Except where required by law, all sales are final once a billing period has been processed.

7. Intellectual Property

All website content, artwork, stories, designs, trademarks, and branding are owned by Little Birds or used with permission and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written permission.

8. Disclaimer of Warranties

Our services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Liability

To the maximum extent permitted by law, Little Birds will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill arising out of or related to your use of our services.

To the extent permitted by law, our total liability for any claim related to these Terms or our services will not exceed the amount you paid us in the 12 months before the claim arose.

10. Indemnification

You agree to defend, indemnify, and hold harmless Little Birds from any claims, liabilities, damages, and expenses (including reasonable attorneys' fees) arising from your misuse of our services or violation of these Terms or applicable law.

11. Governing Law and Disputes

These Terms are governed by the laws of the state and country where Little Birds has its principal place of business, without regard to conflict-of-law principles. You agree to attempt to resolve disputes with us informally first by contacting us at the email below.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date above. Your continued use of our services after updates become effective constitutes your acceptance of the revised Terms.
